Terms and conditions for Doom® (1993) Automower® Beta Update

The software includes the aggregated Chocolate Doom game engine software adapted for use on certain Husqvarna Automower® NERA robotic lawnmower models, namely Husqvarna Automower® 450X NERA, Husqvarna Automower® 430X NERA, Husqvarna Automower® 320 NERA, Husqvarna Automower® 310E NERA and Husqvarna Automower® 410XE NERA (“Chocolate Doom for Automower®”) and the requisite WAD files (the “WAD Software”) (jointly the “Doom® (1993) Automower® Beta Update”).

The Doom® (1993) Automower® Beta Update will be made available for download via the Husqvarna Automower® Connect App exclusively for owners of the Husqvarna Automower® NERA robotic lawnmower models as specified above. In order for an owner to access the Doom® (1993) Automower® Beta Update, the owner must register for such update here www.husqvarna.com/register-doom. The last day for submitting a registration is August 26, 2024. Husqvarna will make available the Doom® (1993) Automower® Beta Update for download via the Automower® Connect Application. It may take a week from registration until the Doom® (1993) Automower® Beta Update is playable on your Automower® robotic lawnmower. The Doom® (1993) Automower® Beta Update is only available in the countries specified on https://www.husqvarna.com/doom.

You acknowledge and agree that you are at least 18 years of age and that the Doom® (1993) Automower® Beta Update and its associated functionality will only be playable on your Automower® robotic lawnmower from April 9, 2024, until September 9, 2024 whereafter the Doom® (1993) Automower® Beta Update® will be removed from your Husqvarna Automower® robotic lawnmower by way of another software update initiated by Husqvarna. You further acknowledge that downloading, installing or keeping the Doom® (1993) Automower® Beta Update on or to your Husqvarna Automower® robotic lawnmower on your own initiative after September 9, 2024 is strongly discouraged by Husqvarna and may have a negative impact on your Husqvarna Automower® robotic lawnmower’s intended functionality, including preventing further software upgrades to your Husqvarna Automower® robotic lawnmower.

You also acknowledge that the WAD Software is licensed to Husqvarna under the Limited Use Software License Agreement, and, in turn, you also agree to comply with said license. Such license e.g. prescribes that you shall not be modifying, translating, dissembling, decompiling, reverse engineering, or creating derivative works based on the WAD Software. Such license also prescribe that you agree that the WAD Software will not be shipped, transferred or exported into any country in violation of the U.S. Export Administration Act and that you will not utilize, in any other manner, the WAD Software in violation of applicable laws. Husqvarna reserves the right to refuse a certain owner from downloading or using the Doom® (1993) Automower® Beta Update, and to withdraw the Doom® (1993) Automower® Beta Update, at any time and in its own reasonable discretion. The dates set out above are indicative and non-binding for Husqvarna.

You expressly acknowledge and agree that the use of The Doom® (1993) Automower® Beta Update is at your sole risk. The Doom® (1993) Automower® Beta Update is a Beta version and is provided “as-is” and without warranty of any kind. Husqvarna hereby disclaims any representations or warranties of any kind, express or implied, including without limitation, warranties of merchantability, satisfactory quality, accessibility or fitness for a particular purpose and non-infringement of third party rights. Husqvarna does not warrant or make any representations as to the security, or any up-time or availability, of the Doom® (1993) Automower® Beta Update. Husqvarna does not warrant that the Doom® (1993) Automower® Beta Update is free from any viruses or any other harmful elements. All representations, warranties and conditions are excluded to the extent that mandatory law permits their exclusion.

To the extent not prohibited by applicable law, in no event shall Husqvarna be liable for any direct, indirect, consequential, punitive, special or incidental damages (including without limitation, damages for loss of business, contract, revenue, data, personal injury, information or business interruption) resulting from, arising, out of or in connection with the use of, or inability to use the Doom® (1993) Automower® Beta Update or out of or in connection with these terms and conditions, even if Husqvarna has been advised of the possibility of such damages. In addition to the terms set forth herein, in no event shall Husqvarna be liable for any errors, inaccuracies, omissions or other defects in the Doom® (1993) Automower® Beta Update. The same shall apply and shall include personal liability of its and Husqvarna’s employees, representatives and other agents.

The Doom® (1993) Automower® Beta Update is controlled, operated and administered in Sweden by Husqvarna from its office in Sweden. If you access the Doom® (1993) Automower® Beta Update outside of Sweden, you are responsible for compliance with all local laws. These terms and conditions and any use of the Doom® (1993) Automower® Beta Update shall be construed in accordance with and governed by Swedish law, without giving effect to its conflict of laws provisions. The Stockholm District Court shall have exclusive jurisdiction in first instance on any disputes arising from these terms and conditions; provided that nothing herein shall prevent the application and enforcement of mandatory and applicable law.
