Private policy Husqvarna Connect

1.1 General

Husqvarna, address: SE-561 82 Huskvarna, Sweden, corporate identity number: 556000-5331, is the controller of the personal data processed in connection with the mobile application attributable to Husqvarna’s digital service, Husqvarna Connect (the “Service”)  The terms and conditions for the Service is governed by the Service Agreement.

Husqvarna is, in its capacity as controller,  responsible for ensuring that all processing of personal data takes place in accordance with the EU Directive 95/46/EC (the "Directive") and, as from 25 May 2018, Regulation (EU) 2016/679 General Data Protection Regulation (the "GDPR"), and such national legislation implementing the Directive and the GDPR (together the "Data Protection Legislation").

 

1.2 Collection and use of personal data and other user information

Please note that in order to use the Service it will be necessary for you to provide personal data (such as e-mail address, name, technical information about the mobile devices used, technical information about the Husqvarna Product and its usage). Additionally, some features of the Service may require that further information is provided. If that is the case, you will be informed hereof in each case and you may decide whether to use such features. Additionally, we may collect information relating to your use of the Service. If so, you will be informed about such processing in accordance with the Data Protection Legislation. Husqvarna might also request additional non-mandatory information from you in order to improve its knowledge of its customers or to conduct direct marketing or invite you to a contest. It is optional for you to respond to any such requests for additional information. Your response to such requests does not have any influence on your use of the Service.

The main purpose of the processing of your personal data is to provide you with the Service for your Husqvarna Product, including providing support (thus, the legal basis for the processing is the fulfilment of the Service Agreement), but the information may also be used for product development, marketing, research and development and analysis of features (the processing is in these cases necessary for the foregoing legitimate interests). 

As the purpose of the Service inter alia is to provide additional functionality to improve your use and maintenance of the Husqvarna Product, we may provide you with information regarding services, spare parts and accessories relating to the Husqvarna Product. Except for the foregoing, Husqvarna will only send you marketing and promotional offers and information by email, electronic text messaging (SMS) or other similar automated system for individual communication if we have obtained your prior consent which you may withdraw at any time using the Contact details under Section 10. Withdrawal of consent does not affect the lawfulness of any processing activities that have been made prior to such withdrawal.

Husqvarna may also processes your personal data only if required for complying with a legal obligation. Your personal data will be stored for as long as it is needed for Husqvarna to fulfill the purposes listed above, but never longer than permitted by the Data Protection Legislation or other applicable law. After termination of the Service Agreement, we will either delete or anonymize your personal data, unless statutory retention requirements apply (such as for taxation purposes). We may retain your contact details for a longer period of time to the extent this is allowed for marketing purposes. We may also retain your personal data after the termination of the Service Agreement to the extent required by applicable law or if we need your personal data to establish, exercise or defend a legal claim. To the extent possible, we will restrict the processing of your personal data for such limited purposes after the termination of the Service Agreement.

 

1.3 Disclosure and transfer of personal data

Husqvarna may transfer your personal data to third parties such as other companies within the Husqvarna Group, dealers, the company hosting the servers on which personal data attributable to the Service will be stored, as well as other service providers with whom Husqvarna contracts to carry out internal operation relating to Husqvarna Connect or of our general business (such as IT-consultants) or as may be required by law or court order. The transferred personal data may only be used by the third parties to fulfil their services to Husqvarna. Any other use of the personal data by the third parties is strictly prohibited.  Transfer to third countries, i.e. countries outside of the EU/EEA is currently not anticipated. If Husqvarna nonetheless will make such transfer, Husqvarna will apply appropriate safeguards pursuant to the Data Protection Regulation as well as make a reference to such safeguards, including the means by which to obtain a copy of them or information on where they have been made available.

 

1.4 Your rights

You have a number of rights pursuant to the Data Protection Legislation in relation to Husqvarna's processing of your personal data, including (as relevant) a right to access (a record that shows, inter alia, what data is being processed about you), right to rectification, right to erasure (right to be forgotten), right to restriction of processing, right to portability and a right to objection. If you wish to exercise these rights, please send us a request to consumer.support@husqvarna.co.uk. You have also the right to lodge a complaint with the applicable supervisory authority.
